KVKK Aydınlatma Metni

Bu aydınlatma metni, 6698 sayılı Kişisel Verilerin Korunması Kanunu'nun ("KVKK") 10. maddesi uyarınca, Serova Fresh ("Şirket") tarafından, internet sitemizi ziyaret eden ve teklif formu ya da iletişim kanallarımız aracılığıyla bize ulaşan kişileri bilgilendirmek amacıyla hazırlanmıştır.

2. İşlenen kişisel veriler

• Kimlik bilgisi: ad, soyad.
• İletişim bilgisi: telefon numarası, e-posta adresi.
• Müşteri işlem bilgisi: firma adı, ilgilenilen ürünler, tahmini miktar, ambalaj tercihi, teslim yeri ve tarihi, iletilen notlar.
• İşlem güvenliği bilgisi: site barındırma hizmeti sağlayıcısının tuttuğu teknik kayıtlar (IP adresi, tarih ve saat gibi).

3. İşleme amaçları

• Fiyat teklifi taleplerinin alınması, değerlendirilmesi ve yanıtlanması,
• Sipariş, sözleşme ve satış süreçlerinin yürütülmesi,
• Sorularınızın yanıtlanması ve sizinle iletişim kurulması,
• Hukuki yükümlülüklerin yerine getirilmesi ve yetkili kurumlara bilgi verilmesi,
• İnternet sitesinin güvenliğinin sağlanması.

4. Hukuki sebep ve toplama yöntemi

Kişisel verileriniz; internet sitemizdeki teklif formu, WhatsApp, e-posta ve telefon kanallarıyla, sizin tarafınızdan iletilmesi yoluyla otomatik ya da kısmen otomatik yöntemlerle toplanır.

Bu veriler KVKK'nın 5. maddesinin 2. fıkrasında yer alan şu hukuki sebeplere dayanılarak işlenir:

• (c) Bir sözleşmenin kurulması veya ifasıyla doğrudan ilgili olması (teklif ve sipariş süreçleri),
• (ç) Veri sorumlusunun hukuki yükümlülüğünü yerine getirebilmesi için zorunlu olması,
• (f) İlgili kişinin temel hak ve özgürlüklerine zarar vermemek kaydıyla, veri sorumlusunun meşru menfaatleri için zorunlu olması.

5. Kişisel verilerin aktarılması

Kişisel verileriniz, yukarıdaki amaçlarla sınırlı olarak; yasal yükümlülükler kapsamında yetkili kamu kurum ve kuruluşlarına, hizmet aldığımız muhasebe, hukuk ve barındırma (hosting) hizmeti sağlayıcılarına ve siparişin teslimi için lojistik firmalarına aktarılabilir.

Yurt dışına aktarım: Teklif talebinizi WhatsApp üzerinden göndermeyi seçerseniz, mesajınız WhatsApp hizmetini sunan Meta Platforms tarafından işlenir ve bu kapsamda verileriniz yurt dışındaki sunuculara aktarılabilir. Bu aktarım, sizin tercih ettiğiniz iletişim kanalının kullanılması için gereklidir. Verilerinizin yurt dışına aktarılmasını istemiyorsanız talebinizi telefon veya e-posta yoluyla iletebilirsiniz.

6. Saklama süresi

Kişisel verileriniz, işleme amacının gerektirdiği süre ve ilgili mevzuatta öngörülen saklama süreleri boyunca saklanır. Sözleşmeye dönüşmeyen teklif talepleri makul bir süre sonunda silinir, yok edilir veya anonim hale getirilir.

7. KVKK kapsamındaki haklarınız

KVKK'nın 11. maddesi uyarınca veri sorumlusuna başvurarak:

• Kişisel verilerinizin işlenip işlenmediğini öğrenme,
• İşlenmişse buna ilişkin bilgi talep etme,
• İşlenme amacını ve bunların amacına uygun kullanılıp kullanılmadığını öğrenme,
• Yurt içinde veya yurt dışında aktarıldığı üçüncü kişileri bilme,
• Eksik veya yanlış işlenmişse düzeltilmesini isteme,
• KVKK'nın 7. maddesindeki şartlar çerçevesinde silinmesini veya yok edilmesini isteme,
• Düzeltme, silme veya yok etme işlemlerinin, verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme,
• İşlenen verilerin münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle aleyhinize bir sonucun ortaya çıkmasına itiraz etme,
• Kanuna aykırı işleme sebebiyle zarara uğramanız halinde zararın giderilmesini talep etme

haklarına sahipsiniz.

8. Başvuru

Haklarınıza ilişkin taleplerinizi, kimliğinizi tespit edici bilgilerle birlikte yazılı olarak yukarıdaki adresimize iletebilir veya adresine e-posta ile gönderebilirsiniz. Başvurunuz, talebin niteliğine göre en kısa sürede ve en geç 30 gün içinde ücretsiz olarak sonuçlandırılır. İşlemin ayrıca bir maliyet gerektirmesi halinde, Kişisel Verileri Koruma Kurulu tarafından belirlenen tarifedeki ücret alınabilir.

9. Çerezler ve tarayıcı depolaması

Sitemiz reklam veya ziyaretçi takibi amacıyla çerez kullanmaz. Yalnızca aşağıdaki işlevsel kayıtlar ve üçüncü taraf hizmetler kullanılır:

2. Personal data we process

• Identity: first and last name.
• Contact: phone number, email address.
• Customer transaction: company name, products of interest, estimated quantity, packaging preference, delivery location and date, notes you send.
• Security: technical logs kept by our hosting provider (such as IP address, date and time).

3. Purposes of processing

• Receiving, evaluating and answering quote requests,
• Carrying out order, contract and sales processes,
• Answering your questions and communicating with you,
• Meeting legal obligations and providing information to authorised bodies,
• Keeping the website secure.

4. Legal basis and collection method

Your personal data is collected by automated or partly automated means when you send it to us through the quote form on our website, WhatsApp, email or phone.

It is processed on the following legal grounds under Article 5(2) of the KVKK:

• (c) It is directly related to the conclusion or performance of a contract (quote and order processes),
• (ç) It is necessary for the data controller to meet its legal obligations,
• (f) It is necessary for the legitimate interests of the data controller, provided that it does not harm your fundamental rights and freedoms.

5. Transfer of personal data

Within the limits of the purposes above, your personal data may be shared with authorised public bodies under legal obligations, with the accounting, legal and hosting service providers we work with, and with logistics companies for order delivery.

Transfer abroad: If you choose to send your quote request via WhatsApp, your message is processed by Meta Platforms, which provides the WhatsApp service, and your data may be transferred to servers outside Türkiye. This transfer is needed to use the contact channel you have chosen. If you do not want your data transferred abroad, you can send your request by phone or email.

6. Retention period

Your personal data is kept for as long as the purpose of processing requires and for the retention periods set by the relevant legislation. Quote requests that do not turn into a contract are deleted, destroyed or anonymised after a reasonable period.

7. Your rights under the KVKK

Under Article 11 of the KVKK, you can apply to the data controller to:

• Learn whether your personal data is processed,
• Request information if it has been processed,
• Learn the purpose of processing and whether it is used accordingly,
• Know the third parties in Türkiye or abroad to whom it is transferred,
• Request correction if it is incomplete or inaccurate,
• Request deletion or destruction under the conditions in Article 7 of the KVKK,
• Request that third parties to whom the data was transferred be notified of any correction, deletion or destruction,
• Object to a result against you arising from analysis of your data exclusively by automated systems,
• Claim compensation if you suffer damage due to unlawful processing.

8. How to apply

You can send requests about your rights in writing to our address above, together with information that identifies you, or by email to . Your request will be answered free of charge as soon as possible and within 30 days at the latest, depending on its nature. If the process involves an additional cost, a fee may be charged according to the tariff set by the Personal Data Protection Board.

9. Cookies and browser storage

Our website does not use cookies for advertising or visitor tracking. Only the following functional records and third-party services are used:
